1. Agreement to Terms

We make every effort to display as accurately as possible the colors, features, specifications, and details of the Products available on our Services. However, we cannot guarantee that your computer's display of any color will be accurate, and we do not warrant that Product descriptions or other Content is accurate, complete, reliable, current, or error-free.

4.2 Product Availability

All Products are subject to availability. We reserve the right to discontinue any Products at any time. If a Product is unavailable after you place an Order, we will notify you and provide options for substitution, backorder, or cancellation.

4.3 Placing Orders

By placing an Order, you make an offer to purchase Products at the prices and with the fees listed at the time of your Order. We reserve the right to accept or decline your Order for any reason, including but not limited to unavailability of Products, errors in Product or pricing information, or concerns about the authenticity of the Order.

4.4 Order Confirmation

After you place an Order, you will receive an email acknowledging that we have received your Order. This email does not constitute acceptance of your Order. We will send a separate email confirming acceptance of your Order when the Products are dispatched.

4.5 Pricing and Payment

All prices are shown in the currency indicated on the website and include VAT where applicable. Shipping fees and any other applicable fees will be added to the price of Products during the checkout process.

We accept various payment methods as indicated on our Services. By providing payment information, you represent and warrant that you have the legal right to use the payment method you provide and that the information you supply is true, correct, and complete.

We reserve the right to correct any pricing errors, even after we have sent you an Order confirmation.

5. Shipping and Delivery

We offer various shipping methods as indicated during the checkout process. Shipping fees vary depending on the destination, size, and weight of the Order, and the shipping method selected.

5.2 Delivery Times

Estimated delivery times are provided during the checkout process but are not guaranteed. Factors outside our control, such as customs clearance or local delivery conditions, may affect actual delivery times.

5.3 Risk of Loss

The risk of loss and title for Products purchased passes to you upon delivery of the Products to the carrier.

5.4 Inspection Upon Delivery

You should inspect all Products upon delivery for any damages or discrepancies. Any issues should be reported to us within 48 hours of delivery.

7. Content and Intellectual Property

All Content included on the Services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of HellCVase or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

7.2 User Content

By submitting User Content to our Services (such as reviews, comments, or photos), you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media.

You represent and warrant that:

• You own the User Content you submit or have the right to grant the license described above
• The User Content does not violate the privacy rights, publicity rights, copyright, contractual rights, or any other rights of any person

7.3 Prohibited Content

You may not submit User Content that:

• Is false, misleading, or fraudulent
• Is defamatory, obscene, pornographic, vulgar, or offensive
• Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group
• Violates any third party's rights, including intellectual property rights

• Contains software viruses or any other malicious code

We reserve the right to remove any User Content at our sole discretion.

THE SERVICES AND ALL CONTENT AND PRODUCTS AVAILABLE THROUGH THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WITHOUT LIMITING THE FOREGOING, WE EXPLICITLY DISCLAIM ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, OR NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE MAKE NO WARRANTY THAT THE SERVICES OR PRODUCTS WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HELLCVASE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless HellCVase, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

12. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the courts of the United Kingdom. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them.

Your continued use of the Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

14. Miscellaneous

These Terms, our Privacy Policy, and our Refund Policy constitute the sole and entire agreement between you and HellCVase regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

14.2 Waiver

No waiver of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

14.3 Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

14.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.
